These Terms of Service ("Terms") govern your use of TalkingWebsite, operated by Gaia Trust T/as Sunaiva (ABN 93 745 481 626) ("we", "us", "our"). By subscribing to or using our service, you agree to these Terms.
TalkingWebsite provides AI voice agent technology that allows website visitors to have voice conversations with an AI trained on your business information. The service includes setup, hosting, and ongoing operation of the AI voice agent.
Subscriptions are billed monthly in advance. You may cancel at any time with 30 days notice. No refunds are provided for partial billing periods. We reserve the right to change pricing with 60 days notice to existing subscribers. Beta pricing is locked for the duration of your subscription if you subscribed during the beta period.
You must not use TalkingWebsite to:
You retain ownership of your business information and content. You grant us a licence to use your content to operate and improve the service. You warrant that your content does not infringe any third-party rights.
We aim for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for any losses resulting from service interruptions outside our reasonable control.
To the maximum extent permitted by Australian law, our total liability to you for any claims arising from the service is limited to the fees you paid in the three months preceding the claim.
Either party may terminate the service with 30 days written notice. We may terminate immediately for material breach of these Terms.
These Terms are governed by the laws of Queensland, Australia. Disputes will be resolved in the courts of Queensland.
